Elon Musk date set for court contempt hearing

On April 4, Elon Musk's lawyers (and possibly Musk himself) will appear in New York for their pleadings to counter the Securities and Exchange Commission (SEC) claim that Musk is in defiance of a decision supposedly to prevent him from making false declarations Twitter.

The latest salvo between Tesla's CEO and the SEC began in February, when Musk tweeted that Tesla would manufacture 500,000 cars in 2019. The company announced in public reports that it would make about 400,000.

For the SEC, this incorrect tweet constituted a violation of a decision made against Musk last year, when Musk lied about the "funding obtained" for Tesla to be deprived of $ 420. per share in August. A few days later, the SEC asked Musk to prove that he was not in contempt of court. To back up his accusations, the SEC not only returned to the tweet, but also to an interview with Musk with "60 Minutes", during which he declared that there was no czar on Twitter at Tesla and that "mistakes" could be made.

Musk responded to the SEC by saying that she was trying to expand the terms of her settlement by limiting her speech on Twitter and that by doing so, she was seeking to violate her first amendment rights.

Musk also stated that he had "diligently tried to comply" with the SEC and that the SEC's use of his comments during his interview with "60 Minutes" of the CBS as evidence of his violation reflected an "unprecedented overrun on the part of the SEC."
