On Thursday, a federal judge rejected a petition from some 80 plaintiffs outside the country who filed a lawsuit against Merck & Co Inc. for the Zoster Zax vaccine to have their case transferred to federal court in the state of New Jersey. "flagrant" jurisdiction.
Judge Peter Sheridan of the US District of Trenton, New Jersey, said that all patients had received the vaccine at different times, in different States and by different health care providers, which prevented him from arguing substantially similar claims, an obligation to participate properly in the prosecution.
