The High Court of Kenya has rejected a request to decriminalize female genital mutilation (FGM) for adult women.
The judges ruled that this practice violated the right to health, dignity and, in some cases, the right to life.
“[The] the court believes that one cannot choose to harm oneself, “says the ruling.
The judges also said that the person behind the case had failed to prove that there was “public participation or insufficient public participation”.
FGM is the deliberate cutting or removal of a woman’s external genitalia and often involves the removal or cutting of the labia and clitoris.
The case followed a 2017 petition from a doctor who claimed the practice’s ban was unconstitutional because women had the right to choose what to do with their bodies.
Dr Tatu Kamau said women should be able to undergo the traditional practice in the hospital, without fear of being arrested.
FGM was banned in Kenya in 2017.
Activists feared the case would delay their attempts to eradicate the process.
