The Supreme Court ruled yesterday on Exton Cubic's application for judicial review against the decision of the Kumasi Human Rights Tribunal, presided over by his judge Akrofi, ordered Exton cubic to pursue the appeal. that she had lodged against the decision of the High Court. on the unfair seizure of its expensive and heavy mining equipment.

However, yesterday's decision by the Supreme Court has nothing to do with the substance of the concessions and mining leases held by Exton Cubic.

It will be remembered that in 2018, the Accra High Court upheld the lease of Exton Cubic and declared that the government's revocation of its lease was erroneous and unlawful and consequently overturned the decision of the Minister of Lands and Natural Resources to revoke Exton Cubic's mining lease.

Last year, Exton Cubic sued the Attorney General in the Kumasi High Court for unjustified detention and seizure of his equipment in Nyinahini, in the Ashanti region, after gaining cause in the bottom of their mining claims before the High Court in Accra on February 8th. , 2018.

Following this decision in Accra on February 8 in favor of Exton Cubic, they went to the Kumasi High Court. But the Kumasi High Court rejected his claim for compensation last June. Exton Cubic subsequently appealed this judgment to the Court of Appeal.

In the application for judicial review, Exton Cubic argued that the Kumasi High Court was not empowered to make certain constitutional declarations in its June 2018 judgment.

Exton Cubic asked the Supreme Court to overturn the decision of the High Court. However, the Supreme Court, after asking Exton cubic's lawyers in open court whether they had appealed the decision, ordered Exton cubic to continue the appeal.

After Exton Cubic's Board honestly admitted that there was a pending appeal, the Supreme Court dismissed the case brought by Exton Cubic and ordered him to continue the appeal. When he went to the Supreme Court, he would review the facts and make a decision accordingly.

Exton Cubic lawyers indicated that they were waiting for the appeal process to be completed so that the appeal could be heard in order to obtain compensation for the seizure and subsequent surrender. material at the Court of Appeal.
