The true state of fertilizer has become one of the main topics of contention of the trial. While the prosecution witnesses maintain that the product was powdery, Mr. Agongo's lawyers insist that it is in liquid form.

At the hearing on December 17, 2018, Mr. Johannes Velba, Deputy Director of Legal Services at COCOBOD, told the court that efforts to locate certain documents essential to the current trial and in possession of CRIG had revealed the possibility of erasing, renumbering and altering certain documents, hence the need to set up a committee to examine the issue.

When pursuing his cross-examination of the 2nd Prosecution witness, Mr. Alfred Arthur, in court on Tuesday, February 12, 2019, Mr. Nutsukpui stated that the deletions were intended to cover the description of the case. fertilizer as a liquid agrochemical.

He also cited the disappearance of a letter bearing the reference number CRIG39 / 14Vol.19 / 6448 of 21 October 2014 to support his remarks.

According to him, this letter also disappeared because its title was also called "Lithovit liquid fertilizer".

Q. I suggest to you that the ad hoc committee, Evans Anim, found that these documents, the budget and the invoice were in the CRIG files.

A. My lord, I'm not aware of that.

Q. And indeed, they attached copies of these documents to their report.

A. I do not know, my lord

Q. I further submit that these documents; that is, the invoice, receipt and budget were all found in the custody of CRIG and attached to the report that was published by the Evans Anim Committee.

A. My lord, I'm not aware of this information.

Q. I also point out to you that all these documents and the report were handed to the Council of COCOBOD, Mr. Johannes Velba, by the director of the CRIG, for his removal to this honorable court.

A. My lord, I'm not aware of that.

Q. I'm telling you that as early as 2014, CRIG itself described the product as a Lithovit Liquid Fertilizer.

A. It is not correct, my lord

Q. Let me add that the letter under reference CRIG39 / 14Vol.19 / 6448 disappeared because its letterhead there also described the product as a Lithovit liquid fertilizer.
