The French government fired Robby Judes after two women claimed he had pelted them during an official visit to New Caledonia in February.
"In my opinion, an offense was committed, but I found that the response of the Foreign Ministry was proportional to the seriousness of what had happened," said prosecutor Alexis Bouroz to AFP.
Judes denied the charges, but Paris officials fired him in March after reminding him to Paris to explain him.
One of the alleged victims, Cherifa Linossier, who runs a group of companies, accused Judes of "rubbing her bad a couple of times during a badtail" although she "has expressed his disapproval ".
