Saanie Daara sued Tiger Eye, Anas and the Attorney General for violation of privacy in relation to the documentary Number12. The respondents responded to the complaint and so filed their statement of opposition witness to the relics sought by Sannie.

Saani Daara asked the Court to dismiss the statement of the witness presented by their lawyers (Anas and Tiger Eye PI) on behalf of half of the defendants (by hearsay).

Mr. Daara's lawyers also asked the Court to allow his lawyers to cross-examine the defendants' attorney who has sworn to declare the testimony.

Finally, he asked the Court that, if it quashed the witness's statement, it should proceed and hear the case without the defendants having to testify.

Defendants 'lawyers alleged that because of the nature of the death threats against the defendants' lives (1st and 2nd), it was imperative that their lawyers be allowed to take their place. They go on to say that the information that the respondents would submit to the court is the information that they provided to their lawyers.

The Court was of the view that, even if the life of the defendants was threatened, it was not a sufficient excuse to find exceptions allowed by the IC 47 for a lawyer to be able to appear at the place of their clients who treated him as an unavailable witness.

The Court stated that it had become aware of the fact that a member of Tiger Eye PI had been killed and that, by the nature of the proceedings before the Court of Human Rights, this case would be primarily engaged on an affidavit.

The judge went on to say that because the affair would proceed on an affidavit, no respondent's agent would be compelled to appear in person for cross-examination. . And as they will not appear in court, they will at least have to visit their lawyers and write their witness statements to present to the court.

They have since done that. An badociate of Tiger Eye will simply swear that the same affidavit will be presented in court this week. Anas will not be in court and will not make any personal statement in court.

The court never ordered Anas to appear in court to defend himself. This is purely false peddling.
