The Mbadachusetts District Court Judge for Nantucket, the affluent island community where the alleged badault took place, called Little Monday to testify. Spacey was not present in the yard.

He stated that he had taken a video of the incident on his smartphone, which allegedly took place while he was an 18-year-old boy in a Nantucket bar-restaurant.

The images of the smartphone, which Little said she shared with a friend of the time and a group of friends, would show that Spacey was thrusting his hand into the teenager 's pants and caressing him.

But the phone – which the defense wanted to review – has disappeared, as Little and his parents, who were also called to testify Monday, confirmed.

A police officer stated that he had returned the phone to the family after extracting all the information but had admitted to neglecting to request a receipt upon his return. The family said they never received the phone.

But when he was warned that manipulating the information over the phone was likely to lead to prosecution against him, Little pleaded the fifth.

Heather Unruh, Little's mother, a television news anchor known in the Boston area, admitted that she had erased some potentially embarrbading photos before giving the phone to the police, but added that she had nothing erased from the alleged badault.

Spacey's lawyer, Alan Jackson, hinted that Little's posts – which was a fan of the actor – implied that his consent to the situation had been removed.

"This whole thing is completely compromised," Jackson said.

"This case must be filed and filed today."

Although the judge did not make a decision, the Spacey defense added that she would promptly request that the case be closed.

The prosecution did not decide to dismiss the case, but asked the judge a week to rule.

Spacey insisted on his innocence in this matter. The charges are punishable by up to five years in prison.
