Spacey's lawyer, Alan Jackson, hinted that Little's posts – which was a fan of the actor – implied that his consent to the situation had been removed.
"This whole thing is completely compromised," Jackson said.
"This case must be filed and filed today."
Although the judge did not make a decision, the Spacey defense added that she would promptly request that the case be closed.
The prosecution did not decide to dismiss the case, but asked the judge a week to rule.
Spacey insisted on his innocence in this matter. The charges are punishable by up to five years in prison.
