Supreme Court to rule on Mahama’s request to inspect EC documents today

The Supreme Court will continue the hearing of the 2020 election petition case filed by the National Democratic Congress (NDC) presidential candidate John Dramani Mahama later today, Wednesday, February 3.

The court released Mr. Mahama’s second witness, Dr. Michael Kpessa-Whyte, on Tuesday after being cross-examined by lawyers for the first and second respondents.

Mahama, through his lawyers, filed a petition in court on Tuesday for permission to inspect the Election Commission documents.

His lawyers, headed by Tsatsu Tsikata, filed the claim.

The documents Mr. Mahama wishes to inspect include the original constituency presidential election results collection forms for all constituencies, the constituency presidential election results summary sheet, the regional presidential election summary sheets for all regions and the presidential results declaration form.

Previously, the petitioner made two requests to the Commission for the Commission to admit certain facts and for Mr Mahama to inspect said documents. However, the Commission did not accede to the requests that gave rise to this request.

The court is expected to hear and rule on the claim this morning.

Mr Mahama’s attorney, Tsatsu Tsikata, told the court yesterday that the ruling on that request will inform their next move regarding summoning more witnesses.

On the last adjourned date, counsel for Defendants 1 and 2 expressed their objection to the motion to the court.

The Court is expected to sit, hear the arguments for and against and decide whether the application will be granted today.
