A Nationwide News appeal on the success of Geoffrey Rush's defamation lawsuit is expected to be heard by three Federal Court judges in November.
According to Judge Michael Wigney, in April, Jonathon Moran, publisher and journalist of the Daily Telegraph, was reckless as to the truth when he reported that the actor had been accused of inappropriate behavior in 2017.
Rush received $ 2.9 million in damages, as well as past and future economic losses.
At a hearing before the Federal Court on Monday, media company attorney, Lyndelle Barnett, said that a scheduled hearing date for the month of August would be too early because they had not yet received the registration of judgment decisions.
The company must also receive the judge's written reasons for one of its decisions.
Among the grounds for appeal, Nationwide News indicates that Wigney J.'s conduct "aroused a fear of bias" and that the audio – particularly with regard to the "tone" used by the judge – corroborates this affirmation.
Rush's lawyer, Sue Chrysanthou, said Monday that the actor's preference was for the issue to be dealt with in the August sessions.
But Ms. Barnett said the actor had received his confirmation after winning the lawsuit.
"There was a judgment in his favor and that is presumed correct until it is annulled on appeal," she said.
"It is not necessary nor urgent that the case be rushed in August, as this will cause harm to my client."
Judge Anthony Besanko said it was "very unlikely" that the appeal would be heard in August, but he expected the date to be fixed in the next week.
