The Sekondi High Court has dismissed a request filed by the lawyer for the first defendant, lawyer Frank Davies, to strike an election petition filed by the NDC parliamentary candidate, Professor Grace Ayensu-Danquah, in the elections of 07 December.
The trial challenged the statement of the first defendant, Mr. Joe Ghartey, winner of the parliamentary elections of December 7, 2020.
Mr Ghartey’s lawyer had asked the court in an earlier session on March 16, 2021, to strike out the election petition on the grounds that the petition lacked merit because it had been signed by the petitioner’s lawyer and not by the petitioner. petitioner herself.
The court, chaired by Dr Richmond Osei Hwere, after legal references and interpretations on Tuesday, March 23, ruled that the first defendant’s request to strike the petition was without merit.
However, the court awarded costs of GH ¢ 4,000 against the lawyer for the first defendant, lawyer K. Amoah, who held the brief, who represented lawyer Frank Davies who was absent in court.
In its ruling, the court said that “lawyers act as the client’s litigation agent, in which case they can sign on behalf of their clients.”
He said the parliamentary election petition is a writ in a different form that can be signed by a lawyer.
