The Supreme Court will resume the hearing of the 2020 election petition on February 5

The Supreme Court will continue hearing the election petition addressed to it by NDC standard bearer John Mahama on Friday, February 5.

The former president who lost the 2020 presidential elections in Ghana to Nana Akufo-Addo of the NPP has filed an election petition with the Supreme Court asking for the results to be quashed.

He alleges that Mr. Akufo-Addo benefited from vote filling and miscalculations supervised and performed by the Election Commission.

The petitioner has since called two witnesses – General Secretary of the Democratic National Congress, Johnson Asiedu Nketia, and Party member Dr Michael Kpessa-Whyte, to support his claims.

At the last sitting, the Supreme Court, in a unanimous decision, rejected a request by Mr. Mahama to be allowed to see six documents held by the Electoral Commission (EC).

This was after EC counsel and President Akufo-Addo raised objections.

Both teams had argued that the documents were already in Mr. Mahama’s custody through his agents who were monitoring elections across the country.

They also insisted that the court apply its ruling on the same issue in the 2012/2013 petition where it rejected such a request.

But speaking to the 7-judge panel after the ruling, lead counsel for the petitioner, Tsatsu Tsikata, said Mr Mahama would like to call a third witness after filing only two for the substantive trial.

He explained that the new witness had health issues and that due to the confidentiality of the witness’s health issue, he would prefer the court to hear him in chambers.

The court then adjourned the session to Friday, February 5 to render its decision on the matter.
