There was no collation of the results at Techiman Sud – Samson Ayenini confirms

Private law practitioner and host of the NewsFile news program, Samson Lardy Ayenini said there was confirmation so far that the Ghana Election Commission has not compiled parliamentary results for the constituency of Techiman South.

According to the lawyer, this is a violation of a requirement of Regulation 43 of IC 127.

The EC said NPP candidate Martin Adjei Mensah-Korsah won with 49,682 votes representing 50.2% of the total valid votes cast, while NDC candidate Christopher Beyere Baasongti won 49,205 votes , or 49.8% of the total valid votes cast.

On this basis, the NPP candidate was declared elected deputy of Techiman Sud.

The NDC opposition, on the other hand, has made it known that it will not sit quietly on the “parody of justice” which threatens to deny its parliamentary candidate for Techiman South in the 2020 general election, Christopher Beyere Baasongti the right to represent the people of the constituency in parliament.

At a press conference last week, the Minorities Caucus in Parliament said a simple compilation of all polling station results in the constituency shows Beyere won the seat by 293 votes, polling 50,306 votes. against the 50013 of the new patriotic party in power, Martin Kwaku Korsah.

There have been calls for the EC to do the right thing by collating the results and publishing the results.

But in an article, lawyer Ayenini said the EC must also apply the law to punish his Techiman South officer for failing to collect the results.

He wrote among others; “… In the meantime, it is established, for the moment, that the CE officer at Techiman South has not assembled (Form One C) as required by regulation 43 of CI 127.”

“Does the EC consider having him treated as having committed an infringement as required by Regulation 45 of IC 127?” he wrote.

Pray – A true horseshoe-shaped parliament with a single independent sitting at the curve at the start of January 7, 2021. Equal number on each side as there is no majority party.

A majority party would have sat on the right side and the minority party on the left. There is the beginning of the problem. Who sits where because whoever manages to form the majority caucus (different from the majority party), can only form it after a speaker has been elected and the independent writes officially to inform the speaker of his decision to do business with that party. So until the president is elected and the processes are completed, there will be no majority caucus.

This means that there will be a decision on the usual / traditional side of the majority for a majority party when the House meets on January 7. A chair has to be elected before elected members can be sworn in and caucus is formed, right? If the Hohoe injunction is in effect or confirmed to affect Jan. 7, the case comes to NPP.

There are every reason why public comments on both sides must reflect this 137 vs. 137 dilemma. If the president decides or is forced by this 137 outcome to have no more than 80 ministers, 41 of that number will come from the 137 of the NPP. He will remain with less than 100 deputies guaranteed to be present in the jurisdiction and in the chamber always.

Building consensus is not a choice in the 8th parliament, even though the NDC managed to overthrow the presidential results and form the government. In the meantime, it is established, for the moment, that the EC agent at Techiman Sud did not collect (Form One C) as required by rule 43 of CI 127.
