But the receiver, in his motion, asked the court to dismiss all the counterclaims of the defendants and part of their defense, which are offensive.

Judge Dadzie, in her decision, struck out part of the counterclaim, claiming that it did not in any way settle the issue in court.

However, it suspended all the accused's pleadings in their defense so that the parties could submit to arbitration.

The court then appointed a retired judge of the Supreme Court, Judge Samuel Kofi Date-Bah, judge, as arbitrator.
