SILVER SPRING, MD (AP) – The popularity of CBD products has increased despite the confusion surrounding their legal status. US regulators are investigating ways to officially authorize hemp ingredient in foods, beverages and dietary supplements.
The US Food and Drug Administration held a hearing Friday to gather information on cannabis compounds such as CBD, which is already available in sweets, syrups, oils, beverages, skin patches and foods for dogs. Products containing CBD are already in stores and sold online.
No decision is expected immediately, but the hearing is considered an important step in clarifying the regulations regarding the ingredient.
Last month, the FDA sent warning letters to companies for their unapproved health claims regarding CBD products.
The CBD does not get people up. It often comes from a cannabis plant known as hemp, which is defined by the US government as containing less than 0.3% THC, the compound that causes the altering effect of marijuana's mind.
For now, the FDA has stated that CBD is not allowed in foods, beverages and supplements, but that it is exploring ways to use it. Adding to the confusion, some states like Colorado allow it in food and beverages. In New York, where officials warned that it was not allowed in food and beverages, restaurants and stores continued to sell products.
"A patchwork of different standards is difficult for everyone," said Shawn Hauser, a lawyer specializing in the law and policy of marijuana.
