Judge Ruth Bader Ginsburg will be back on the bench Tuesday for the time since the December surgery.

The Public Information Office of the Supreme Court confirmed the presence of Ginsburg shortly after 9 o'clock.

The 85-year-old Liberal court member was forced to miss arguments in January for the first time because of her health for more than 25 years.

On December 21, Ginsburg was operated on to remove two cancerous nodules from her left lower lung. The court said on January 11 that Ginsburg's recovery was on track and that a post-operative assessment showed no signs of remaining illness and no further treatment was needed.

Ginsburg was in court Friday for an in camera conference during which the judges decided which cases to consider.

The judges are back on the bench after a winter break of one month. They are supposed to hear a dispute over patent and trademark law involving the US Postal Service.
