It should have been a very moving session in July 1998 in Rome. For three years, the United Nations has discussed the establishment of an International Criminal Court (ICC) in The Hague. At this meeting, the United Nations General Assembly received the green light for the establishment of the International Court of Justice.

The Germans, under the Foreign Minister of the time, Klaus Kinkel, insisted mainly on the creation of an independent Criminal Court

. a new tribunal would be different from the two other international criminal courts that were created to direct the wars in the former Yugoslavia and Rwanda. The Security Council created these courts in the early 1990s, provided that this could have an influence on them.

But the new international court that they wanted to create would be different, and no state could have influence over it. the jurisdiction of the court that could affect international sovereignty was and is unacceptable to the United States and other states. The United States feared that because of US military missions in many parts of the world, US soldiers could be brought before the new international court.

Americans have for years refused to accept the objective existence of the crime of waging a war of aggression.

The United States tried to prevent the creation of an independent International Criminal Court, but July 17, 1998 120 states accepted creation 21, while China, Iraq, Israel, Yemen, Libya, Qatar and the United States voted against. US President Bill Clinton also signed on December 31, 2000, but his successor, George W. Bush, rescinded the agreement two years later.

In March 2003, the newly created court was able to work. The first twenty-eight judges were sworn in.

Twenty years after its establishment, 123 states have joined, but China, the United States, Russia, India, almost all the Arab States, Israel and Iran are not involved [19659008] Participation in the International Criminal Court is voluntary and withdrawal is possible through communication. In 2016, Burundian President Pierre Nourunizsas used this option because he feared a possible prosecution because of the prosecution of journalists and activists after a third illegal presidential term.

The International Criminal Court insists, however, that it remains competent to appeal against the President of Burundi while that country is a member of the International Court of Justice.

Disputes and criticisms of the International Criminal Court have been formulated arguing that the court is aimed primarily at African leaders, despite the fact that war crimes and genocide are also recorded by white men.

Court officials contradict because nowhere in the world is human rights violations more pronounced.
