Groups representing homeowners are calling on a judge to lift the Centers for Disease Control and Prevention’s (CDC) new moratorium on evictions.
The Alabama Association of Realtors, along with other groups, said in an emergency filing Wednesday that the The CDC order is “illegal” and was issued “for purely political reasons – to ease political pressure, to blame the courts for ending the moratorium, and to use litigation deadlines to achieve a political goal” .

Biden noted earlier this week that while most experts say the moratorium is not constitutionally likely to pass, “by the time it goes to court it will likely give a little more time. “to tenants.
“Whether that option will pass constitutional action with this administration, I can’t tell you. I don’t know,” Biden said. “There are a few academics who say it will be, and others who say it is not likely. The Supreme Court ruled in June to allow the CDC to extend its moratorium on original evictions until the end of July, but said congressional approval would be needed for another extension.
The CDC has reduced the new moratorium on evictions to only areas with high COVID-19 transmission rates, but it still applies to 90% of the U.S. population.
