On September 10, 2021, a court-approved legal opinion was posted on prnewswire.com by Hagens Berman Sobol Shapiro LLP and Cohen Milstein Sellers & Toll, PLLC indicating that customers who purchased chicken from January 1, 2009 through December 31, 2020, in certain US states may be eligible to receive a settlement payment if final approval the payment is received.
Persons eligible for the settlement include “persons and entities who have indirectly purchased fresh or frozen raw chicken (defined as whole birds (with or without giblets), cut whole birds purchased in a package, or parts of” white meat “Including breasts and wings (or cuts containing a combination thereof), but excluding chicken marketed as halal, kosher, free-range or organic)”, according to the settlement announcement.
The following states are included in the lawsuit: California, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Massachusetts, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, Caroline of North, Oregon, South Carolina, South Dakota, Tennessee, Utah and Wisconsin.
