The three-month judicial battle between Mahindra and Fiat Chrysler Automobiles (FCA) has come to an end. It may be recalled that FCA dragged Mahindra to court for infringement of intellectual property rights, alleging that Mahindra Roxor was an identical copy of the Jeep model.
The survey staff appointed by the United States has now turned. The Commerce Commission prohibited FCA from continuing the investigation if the Mahindra Roxor contained or used its approved calender design. the Roxor Off Roader was very similar to the Jeep Wrangler which is sold in UAS markets. The company said it was a violation of the copyright and therefore asked a court to ban the sale of Mahindra Roxor in the US market. Mahindra alleged that an agreement had been reached with FCA allowing it to sell to the US vehicles with a different grille than the one used on Jeeps.
In addition to being threatened by the design, FCA also alleged that the Imports of Mahindra Roxor would adversely impact the Jeep's sales because of its lower price. Mahindra gains a cost advantage because its products are manufactured in India and imported to US markets via CKD kits badembled in Detroit.
The decision is now favorable to Mahindra and as a result of this announcement, Mumbai-based Mahindra will be allowed to import the Roxor off-road from India to US markets where it will go on sale as a side-by-side off-road vehicle.
To date, more than 4,000 units of Mahindra Roxor have been sold in the United States, while the company now targets sales of 4,500 to 5,000 units by the end of this fiscal year. The Roxor is an off-road SUV, but not legal, which was launched in the United States in March 2018. Its selling price is 15 000 USD (10 499 475 Rs). It is powered by a diesel engine 4 cylinders of 2.5 liters. Although based on the Mahindra Thar DI, its features have been modified to meet the requirements of the US market: no doors, no hard roof and no windshield.
