While the Delhi High Court has already announced the publication of "Prime Minister Narendra Modi" under the green flag, the Bombay High Court has also refused to interrupt this release but left it to EC to decide whether its filtering should be suspended during the election period.
"The court rulings are very clear.The Supreme Court had previously indicated that once the film had been certified by the CBFC and approved by the Censor Board, it was up to the state governments to facilitate the projection of the film in their jurisdiction EC is likely to follow this principle laid down by the Supreme Court, "said a source from the EC.
A recent Supreme Court order had asked the State of West Bengal to ensure that the film Bangla Bhobishyoter Bhoot was released and screened "without restriction", citing the Censor Board's authorization to the film, its freedom of expression and its freedom of viewing.
"The state of West Bengal is required, once the film is certified by the CBFC, to take the necessary measures to protect the fundamental right of the producer and the director to freedom of speech and expression, as well as the viewers were able to see the film without extraconstitutional restrictions, "the high court said in its March order on Bangla's political satire.
Several parties opposed the release of "Prime Minister Narendra Modi", in which the actor Vivek Oberoi plays the leading role, claiming that this would give the BJP to power an unfair advantage in the prospect Lok Sabha polls.
As a result of the complaints, EC sent a notice to the producers of the film that the film did not receive any funding from BJP and therefore could not be considered as politically motivated.
