Joe Giudice has just been shot by a judge in his immigration case – he has been ordered to remain locked up while his deportation case continues.
Joe asked the court earlier this month – where he appeared via videoconference – to ask to be released pending his appeal of his deportation. Now the judge has ruled, and this is not in his favor.
He will remain locked in the ICE detention center he has been living since his release from prison in March – the Clinton County Detention Center.
The Giudice family lawyer, James Leonard Jr."We are absolutely devastated, our justice system has failed this family, we are now at the mercy of the Third Circuit Court of Appeals, God willing, they will send this man back to his four daughters."
TMZ broke the story … Joe's homesick and tired to stay behind bars and he believes that he should be released from custody while he appeals. Joe says that the least the judge can do is let him see his family, especially if he risks being deported quickly anyway.
As we reported previously … Joe was immediately transferred in detention on ICE when a judge ordered his deportation to his native Italy. This after serving a 41 months for conspiracy to commit electronic fraud and bankruptcy fraud.
Joe appealed this decision and lost. But, he again appealed to a superior court … and that's where we are now. Joe wanted to be home in New Jersey with her family pending the final decision of the judge.
Joe has the opportunity to appeal this bond decision in the next 30 days, but Leonard says it's not an option and they're not on the road to knowing what the call for deportation will be.
