Joe Giudice, husband of star Teresa Giudice of "Real Housewives of New Jersey," attempted to avoid being deported to Italy after spending more than three years in prison.
But Giudice, 46, saw his hopes disappointed – his appeal was rejected.
James Leonard Jr., Giudice's family lawyer, confirmed to NJ Advance Media that the Immigration Appeals Board had dismissed Giudice's appeal of an eviction order.
In October, a judge ordered Giudice to be deported after serving a 41-month sentence in a federal prison in Allenwood, Pennsylvania. In March, Giudice completed his prison term, but was not allowed to return home. Instead, he was directly transferred to the custody of the Immigration and Customs Enforcement.
Leonard said that Giudice is being held in an institution for immigration detainees in western Pennsylvania. The lawyer issued a statement Thursday on the failure of the appeal, saying that Giudice's lawyers would continue to do their utmost to prevent his deportation to Italy.

Joe Giudice, who is completing his prison sentence in the coming days, has appealed an eviction order. He was born in Italy and never became an American citizen.
"We are extremely disappointed that the Immigration Appeal Board has dismissed Mr. Giudice's appeal," said Leonard in a statement. "We have filed a stay at the Court of Appeal. call the third circuit and will continue to fight to keep Mr. Giudice as president of the United States, the only country he knows, and reunite him with his wife and four daughters. "
In 2014, Teresa and Joe Giudice were sentenced by a federal court after pleading guilty to bankruptcy fraud and conspiracy to commit wire and mail fraud. Teresa was sentenced to 15 months in prison and served nearly a year in 2015. Joe began her sentence in 2016.
The Giudice live in the Towaco section of Montville and have four girls aged 10 to 18 years.
Giudice was born in Saronno, Italy, and arrived in the United States at the age of 1 year without ever becoming a citizen. Permanent residents who commit crimes of "moral turpitude" may be deported.
Teresa Giudice, 46, married to Joe since 1999, made it clear that she would separate from her husband when he was deported.
"I do not do a long distance relationship," she told Bravo host Andy Cohen during a "RHONJ" meeting episode aired in March. "I just do not do it."
"You know, I want someone with me every day and I know exactly what's going on," Giudice told Cohen. "You know, I'm sure he'll be with other women. You know, it happens. We make the long distance, it will not work. Like, I'll be like, 'bye-bye. "
On Wednesday, Lynne Patton, a Trump administration official, posted a picture on Instagram that showed her dinner with Teresa Giudice at the Quin Hotel's Wayfarer in New York. She called Giudice a long time friend.
Patton, a regional administrator in the US Department of Housing and Urban Development in New York and New Jersey, worked as an event planner for Donald Trump and organized the wedding of his son Eric Trump.
In February, Patton stood behind Rep. Mark Meadows, QC, when Trump's former repairman, Michael Cohen, testified before the House's Monitoring and Reform Committee. Meadows talked about Patton, who is African-American, trying to refute Cohen's claim that Trump is racist. Representative Rashida Tlaib, D-Mich., Stated that it was "racist in and of itself" for Meadows to treat Patton as an accessory (Patton did not speak during his appearance).
Giudice participated in the twelfth season of "Celebrity Apprentice", presented by Donald Trump and aired in 2012.
In his post Instagram, Patton dismissed any hypothesis that Giudice would meet to ask a presidential pardon to Joe Giudice (or that Patton was going to be in a reality show).

Teresa Giudice supported Trump's candidacy for the 2016 presidency, although she could not vote. The star of reality TV had previously mentioned the idea of asking Trump to forgive Joe.
"I would love to talk to him if he wants to call me," she told Cohen during an appearance on "Watch What Happens Live" in 2018. "I did not do it, but I said he wanted to talk to me, I would love that."
