EXCLUSIVE

John Singleton A plan was in place for his death because TMZ learned that he had left a will, which is a monumental advance in what appears to be a family war that broke out while he was in the process to die in the hospital.

Sources with direct knowledge say to TMZ, John's mother, Sheila Ward, is in possession of the will and will soon be filed in the Probate Court. Sheila is busy with all John's business, which includes the last testament.

As we reported last week, Cleopatra, one of John's seven children, accused Sheila of trying to rebalance her assets and squeeze his children. Cleopatra launched her attack after Sheila filed legal documents last week for a temporary curator position while John was unable to make decisions. The legal battle over when John is dead.

If the famous director, aged 51, died without a will, Sheila would get nothing from his declared wealth of $ 35 million, because under California law, assets would be divided equally among his 7 children. But as there is a will, John decides who gets what and who does not win anything.

Given the business relationship between John and Sheila, it's a safe bet that she is the executor of the will, which certainly would not please Cleopatra.

It's hard to know when John signed the will, but it's not out of the question that someone is trying to mount a challenge: the will must be invalid because of undue influence or mental incapacity – this came after Michael Jackson died. Important to note … most of these challenges fail.
