A judge has blocked the sending of American singer Lil Nas X’s “Satan Shoes” to customers.
The controversial sneakers, which contained a drop of human blood and were made from modified Nike Air Max 97, were the subject of a lawsuit by Nike for infringement and dilution of its trademark.
Now a judge has stopped maker MSCHF from shipping the 666 pairs of shoes, which retailed for $ 1,018 to customers. All of the pairs sold out within a minute of going on sale, with Miley Cyrus recently spotted wearing a pair on presale.
U.S. District Judge Eric Komitee has granted Nike a temporary restraining order preventing the shoes from being shipped to customers, according to the Hollywood Reporter.
Nike’s lawyers say they “presented evidence that even sophisticated sneakerheads were confused” by the shoes, believing they were made by Nike. And that “we have presented a lot of evidence (of) evidence that some consumers say they will never buy Nike shoes again.”
Meanwhile, MSCHF says confusion is unlikely due to the “sophistication” of the Nike customer.
Citing “The Rogers Test” arising from a Rogers Vs Grimaldi copyright case, MSCHF argues that the shoes are “individually numbered works of art” that were sold to collectors for $ 1,018 each and, as their previously released Jesus shoes will be exhibited in museums and collections.
The order will remain in effect until there is a fuller trial.
Satan shoes emerged as a tie-in merchandise with the release of the song and video Montero by Lil Nas X (Call Me By Your Name). The video, which saw the singer dancing with the devil, has become a topic of discussion among public figures affiliated with Republicans.
South Dakota Governor Kristi Noem called the video “disgusting” and “perverted” and conservative activist Candace Owens tweeted in part: “We promote Satan Shoes to wear on our feet… But we are convinced that it is white supremacy that keeps black America behind. How stupid can we be? to which Lil Nas X responded: “Don’t care and UR a flop.”
