Judge Stephen Breyer has finally responded to intense speculation about his intention to step down from the Supreme Court to make way for a younger replacement chosen by Biden. In an interview with CNN, the 82-year-old said he hadn’t decided when he was going to quit, but said he enjoyed his time on the bench. When asked if he had decided on his retirement plan, Breyer simply replied, “No. He went on to say that there are two things to consider when making his decision: “Mainly, of course, health … Second, the court.” Breyer said he appreciated his new leadership role in the liberal wing of the tribunal, saying his seniority “made a difference to me … It’s not a fight.” It’s not sarcasm. It is a deliberation. Calls for Breyer to announce his retirement have increased since Senator Mitch McConnell threatened to block a Supreme Court choice of Biden in 2024.
