Judge rejects Democrats' attempt to block transfer of funds for border wall

A federal judge rejected Democrats' request for the House to prevent President Trump from transferring funds for the construction of his wall.

Judge Trevor McFadden ruled that a House of Congress could not sue the executive branch of justice for its expenses.

"It is a question of whether a House of Congress has the" constitutional means "to enlist the judiciary in a political war with the president on the implementation of the legislation," wrote McFadden. "The judiciary can not reach the bottom of this dispute, he argues, because the Constitution does not give the House any right to rule on these claims."

"And while the Constitution confers many powers on members of the House, it does not give them the right to sue the executive power in court, alleging a dilution of congressional legislative authority. The Court therefore has no jurisdiction to hear the Chamber's requests and will reject his application, "he added.

McFadden, appointed by Trump and serving in the US District Court of Columbia, said lawmakers had other options than the court system to put an end to the president's proposals.

Trump issued a national emergency this year, demanding that Pentagon funds be used to build a wall along the US-Mexico border.
