A 9th US Court of Appeals court overturned a major impediment to the construction of the Keystone XL pipeline, claiming it no longer applies after replacement by a license from the company. Trump administration issued a permit earlier this year.
The court ruled late Thursday in favor of the Trump administration and TransCanada Corporation's motion to dismiss.
The decision yielded to the argument that the old pipeline license, which had been replaced by the Trump administration in March, is no longer valid and that, therefore, the injunction that associated with it no longer applies.
The action gives a victory to the Trump administration, which has long fought to complete the construction of the international pipeline. It also opens the door for the resumption of construction of the Keystone XL pipeline, who was arrested in the fall due in part to the lack of proper consideration of the cumulative effects of greenhouse gas emissions from construction.
In May, Trump signed a presidential permit to revive the delayed construction of the 1,179-mile pipeline. The order replaced an order from March 2017.
"For the avoidance of doubt, I hereby revoke that on March 23, 2017, the license," wrote Trump in the order.
A White House spokesman told The Hill at the time that the new permit "will remove all uncertainty."
"More specifically, this license reinforces, as it should have been clear from the beginning, that the presidential permit is indeed an exercise of presidential power – which is not subject to judicial review under the Law on the Procedure. administrative ", said the spokesman.
The pipeline has been a lightning rod in the national energy policy for about a decade since it was proposed by TransCanada.
