Special Prosecutor Dan Webb reported “substantial abuse of discretion and operational failures” in the handling of Jussie Smollet’s case by Cook County State Attorney Kim Foxx.
Webb, who has been tasked with investigating the investigation, released his findings on Smollet’s case and the Foxx treatment on Monday. He writes that Foxx and those who work with her created false statements, later shared with the public regarding Smollet’s dismissal.

Webb’s report continues to say that Foxx and its staff have demonstrated potential ethics violations in their handling of the case. However, the prosecutor found nothing criminal in the treatment of Foxx.
Mark Geragos, Smollett’s lawyer, responded to Webb’s report. He wrote that the report confirms that “there was no wrongdoing or undue influence on Jussie’s part” or his dismissal.

This is a blatant attempt to dismantle a black and progressive prosecutor who does not fit into the white power structure. Jussie, a black gay man who maintains his innocence, continues to be used as a pawn. Today’s report confirms what the defense has always said: There was no wrongdoing or undue influence on the part of Jussie or the defense in dismissing all the charges against him and the second wave of charges is a flagrant constitutional violation.
