Jussie Smollett has just been charged with felony … by filing a fake police report, and the stake is 3 years in prison.

A grand jury from Cook County made the indictment Wednesday night after the grand jurors had heard testimony and evaluated evidence.

We are told Ola and Abel Osundairo – the 2 brothers – says to the great jurors they staged the so-called "attack" on the order of Jussie and was even paid for it. The brothers were photographed buy a lot of supplies before the incident … including ski masks, gloves, bandannas, sunglasses and red hats.

Although police have officially labeled Jussie a "victim" until recentlyMany police sources told us that the police had serious doubts about Jussie's story at the very beginning. They found it strange that he kept the rope around his neck for 42 minutes after "the attack" and that he was suspicious when he drove them to the scene and he immediately pointed a camera that would have captured the incident. It turns out that the camera was headed in the wrong direction.

Abel and Ola told the police that they had driven with Jussie a few days before the incident, looking for a place, and even having repeated "the attack".
