Jussie Smollett and / or his lawyers are willing to sit down with the police, and this decision has avoided a grand jury at the 11th hour … TMZ has learned.

Ola and Abel Osundairo were in a Chicago courthouse Tuesday, ready to testify before the grand jury … according to sources related to the case, however, which was canceled at the last minute. We are told that they have received a call for Jussie's legal team – and maybe Jussie himself – to agree to speak to the police.

Final result … the grand jury has been postponed. We are told that the meeting between the cops and the Jussie team has not yet taken place. We also announced that the grand jury will not meet Wednesday morning.

With regard to the ongoing investigation on "the attack" … the law enforcement authorities think that it happened on January 29, especially because Jussie knew that the Osundairo brothers left for Nigeria the next day. Our sources say that this trip was planned and not connected to the alleged attack.

In addition, we were told that the FBI met with the brothers on Tuesday to talk about the hate mail that had been sent to Jussie at Fox Studios in Chicago. Federal authorities check whether the postage stamp on the letter corresponds to that of the police seized at the brothers in Chicago.

We are told that the FBI also examines the pages of torn magazines found in their home … to see if they correspond to the cut letters used in the racist and homophobic letter.

Our sources say that the brothers told the police that they had nothing to do with the letter and only saw it on a photo of Jussie's phone.
