Left-handed Dodgers Julio Urias Richard Winton and Jorge Castillo, of the Los Angeles Times, will not be subject to criminal charges related to his recent arrest. The decision to "postpone the prosecution" was announced by the Los Angeles City Attorney's Office.
This determination is not absolute. As stated in an official press release, Urias could be prosecuted if it did not fulfill the following three conditions: "(1) that Mr. Urias participate in a hearing of the city prosecutor; (2) he does not commit any act of violence against anyone; and 3) successfully participate in a 52-week domestic violence counseling program in person and in a group setting. This council will take place two hours a week and will take place during the current baseball season.
In particular, as part of the council, Urias will (among other things) "accept responsibility for the abusive behavior perpetrated against the victim". the fact that the alleged victim has never been characterized in this way, and the absence of criminal history of Urias. The L.A. Times report also indicates that there have been discrepancies between witness accounts of a jostling and statements of the alleged victim, who said he had a fall.
From the point of view of baseball, the problem is still not solved. Urias had previously been reinstated from the inactive list, but the commissioner's office said his investigation had not been completed yet. The city prosecutor's statements seem to suggest that there may be evidence that Urias has violated the common policy on domestic violence, sexual assault and child abuse. This policy gives the Commissioner the general authority to make the appropriate disciplinary action, whether or not a crime is charged or prosecuted by the competent judicial authorities. The findings under the league's policy would also be subject to standards different from those of a criminal case.
