Lawyers for Nicholas Immesberger's family claimed that The Woods Jupiter had destroyed the video evidence of the employee drinking at the bar for three hours – to the point of becoming seriously intoxicated – before his fatal accident in December.
The family is suing the restaurant, the owner Tiger Woods and the restaurant's general manager, Erica Herman, Woods' girlfriend, for the wrongful death of Immesberger, who had a blood alcohol level of .256, plus Three times the legal limit in Florida, when he lost control of his car, he crashed and suffered fatal injuries on December 10, 2018. He was 24 years old.
"One of the most important problems we have here is the destruction of evidence," lawyer Spencer Kuvin said on Tuesday. "Obviously, this shows that someone knew that something was wrong and wanted to remove that evidence. We have evidence that shows this video, showing Nick at the bar that night, after that." It came down at 3 pm, after drinking for three hours at the bar was destroyed shortly after the crash.
"So we found evidence during our investigation that the lawyers knew what had happened, that they were aware of the accident and that shortly thereafter, the video evidence had been destroyed and erased from the servers they owned at The Woods. "

Immesberger was a bartender at The Woods, and the lawsuit alleges that Woods, Herman and other employees knew that Immesberger had an alcohol problem but that he regularly monitored him during and after his shifts.
"Tiger knew, or should reasonably have known, that Immesberger was accustomed to being addicted to the use of any or all of the alcoholic beverages and / or that he was a habitual drunkard," says the trial.
The lawsuit alleges that Woods and Herman "drank with him" a few nights before the fatal crash. It is unclear whether Woods or Herman were at the restaurant on December 10 after returning from a trip to Australia on the evening of December 7.
"We are all very sad that Nick has passed away," Woods said during the media availability for the PGA Championship on Tuesday. "It was a terrible night, a terrible end, and just – we feel bad for him and all his family. It is very sad."
Kuvin also said Tuesday that Herman and other restaurant staff knew that Immesberger had destroyed another vehicle just a month before the crash, after being "re-watched" at The Woods.
"Erica specifically asked her to come back to work at the bar and she was aware of her addiction and her problem," Kuvin said.
