The American actor Cuba Gooding Jr., 51, will be tried in September for touching a woman against her will after a New York court dismissed her abandonment application.

Actor born in New York, Gary Maguire, was charged with touching the chest of a woman in a Manhattan bar in June.

Gooding denies being older and his lawyers say the records clearly show that their client is not guilty.

But Phyllis Shaw, a New York criminal court judge, refused to drop the lawsuit.

"The court finds that the defendant has not provided convincing reasons to justify that," Shaw said in a written decision obtained by AFP. The trial will begin on September 3rd.

The convicted felon is punishable by one year 's imprisonment under the laws of the State of New York.

Cuba Gooding Jr. became famous with the release of "Boys in the Hood" (1991). He finally played Jay Simpson in American Crime Story.
