A federal judge on Tuesday refused the early release of Mossimo Giannulli, husband and co-accused of actress Lori Loughlin, who is serving time for his role in a massive college admissions scandal.

The Los Angeles fashion designer hasn’t made an “extraordinary and compelling” argument that he should serve the remainder of his five-month sentence at home, US District Court Judge Nathaniel Gorton said.

Giannulli has argued that his current stint at the federal correctional facility, Lompoc, is particularly harsh due to coronavirus protocols. He claimed that 56 days spent in isolation “had a huge impact on his mental, physical and emotional well-being,” according to court records.

While the court is aware of the onerous conditions imposed on the accused as a result of the Covid-19 emergency response (from the Bureau of Prisons), it has not established that these conditions alone demonstrate a reason ‘ “ extraordinary and compelling ” of his release, “Gorton ruled.

Giannulli had cited the early release of fellow “Operation Varsity Blues” Toby MacFarlane as proof that he should receive the same treatment.

The couple’s attorney could not be immediately reached for comment on Wednesday.
