KUCHING: Dr. Ting Tiong Choon remains elected from Pujut
The Court of Appeal, in a majority decision, upheld a decision of the High Court ruling disqualification as unlawful Dr. Ting by the Sarawak Legislature.
The Court of Appeal dismisses the appeal lodged by the Speaker of the National Assembly, Datuk Amar Asfia Awang Nasar, and the Second Minister of Finance, Datuk Seri Wong Soon Koh, against the decision of the High Court.
Datuk Judges Abang Iskandar Abang Hashim and Harmindar Singh Dhaliwal agreed to dismiss the appeal, stating that the State Assembly had no jurisdiction to disqualify Dr. Ting prior to his election .
Judge Mary Lim Thiam Suan dissented, saying that Dr. Ting was not qualified to be elected to Parliament. he took Australian citizenship.
Judge Abang Iskandar, reading the judgment, stated that the Sarawak Assembly was not the appropriate forum to decide on the membership of Dr. Ting under the terms of the law.
