KUCHING: The Court of Appeal upheld a decision of the High Court that the disqualification of the MP for Pujut DAP, Ting Tiong Choon, by the Sarawak Legislative Assembly on his Australian nationality was illegal.
Last October, the Court of Appeal ruled that the National Assembly had no jurisdiction to disqualify Dr. Ting when he acquired Australian citizenship, to which he subsequently renounced, before being elected at the May 2016 legislative elections.
Going back to determine a person's status prior to his election would amount to an over-reach on the part of the State assembly, which, in my opinion, had the power to determine the status of a person. The two concurring judges dismissed the appeals of Sarawak Chairman Datuk Amar Asfia Awang Nassar, Second Finance Minister Datuk Seri Wong Soon Koh and the state assembly against the decision of the High Court.
