UPDATE: Confusion among prosecutors almost led to the release of the man charged in the New York hit and run of actress Lisa Banes, who appeared in the films Missing girl and Cocktail, as well as Broadway and television.
A prosecutor mistakenly told the judge during a hearing that suspect Brian Boyd should be released without bail. He would have been on probation if the request had been granted.
Manhattan Criminal Court judge James Clynes was then informed of the erroneous notice and set the bond at $ 30,000 for Boyd. He was arrested Thursday for the June 4 collision that resulted in Banes’ death.
Boyd is charged with leaving the scene of a fatal accident and failing to yield to a pedestrian in a crosswalk. He will return to court on August 11.

EARLIER: 26-year-old man from Manhattan was arrested in the June 4 electric scooter hit-and-run incident that killed Cocktail actress Lisa Banes, the NYPD reported on Friday.
Brian Boyd, who lives near the Upper West Side corner of Manhattan around Lincoln Center where Banes, 65, was hit by the scooter, has been charged with leaving the scene in a crash resulting in death and not yielding to a pedestrian in a crosswalk.
Banes, whose credits also included the film Missing girl, TV shows royal pains and A life to live, as well as many Broadway productions, was walking near Lincoln Center’s Julliard School, her alma mater, when she was struck in the crosswalk by the scooter. She died 10 days later from a head trauma.
According to police, Boyd was arrested after patrol officers recognized him on a wanted poster.
Banes, visiting New York City from Los Angeles for a role in the Manhattan Theater Club’s streaming production of The Niceties, was on his way to meet his wife, journalist Kathryn Kranhold, for dinner near Julliard. Police said she was hit after the scooter passed a red light.
