The Federal Office of Consumers (Profeco) is an entity that can impose fines on any company that advertises and that does not respect the benefits that it promises. On this occasion, he imposed them on Uber, Easy Taxi and Cabify "for the probable infringement of the rights of consumers in the country who rent their services".

Thus, the penalty is greater than 6.4 million pesos for these transport companies that use mobile applications to provide their service.

"The above-mentioned effects result from the application of an adhesion contract which has disproportionate, unfair and abusive advantages to the detriment of consumers, coupled with the spread of misleading advertising, through which they offer a "secure service" of transport, which contravenes their conditions in which they establish conditions that distinguish them from any legal responsibility, "explained Profeco in a statement

.

Uber received a penalty for 3 million 974 thousand pesos; at Easy Taxi, for 1 million 810 pesos; and Cabify for 700 thousand pesos. These can still be disputed.

In the particular case of Uber, it is a brand that has made many trips in recent months. Last year, he changed his terms to delimit user security when using the service, an action that earned him various criticisms in social networks.

However, last April, he established seven security measures, including hiring new consultants and taking charge of the travel experience.

Now, Profeco said that "it is estimated that Uber violates the provisions of the law of the case, not to indicate an address, telephone and other means of contact in the country for clarifications or claims for the application of additional service charges without the express consent of the consumer (rate of repair, cleaning or charges for forgotten items) ".

The agency added that for the resolution of any dispute between the users of the service (Uber) and the provider, the parties must submit to arbitration or mediation, established in the legislation of Amsterdam (Netherlands) and in English.

With respect to Cabify, it indicated that this supplier unilaterally establishes that the required fees will not be refundable and, in periods of high demand, a higher variable cost, without clearly defining which criteria will be used.

"As for Easy Taxi, it is not liable for any damages or losses that could be caused by improper use of the information of the Easy and the user equipment in the case where a third party violates security and unlawfully uses the information. "
