Actress Aislinn Derbez denounces before the National Council for the Prevention of Discrimination (Conapred) L'Oreal beauty products company for discrimination against women, creating an "undue, degrading and violating rights stereotype".
The conflict between the daughter of comedian Eugenio Derbez and the company of French origin stemmed from a mercantile lawsuit with which the multinational accused, in July 2017, the actress of breach of contract because she had not applied for permission to represent Saba brand dedicated to the sale of intimate hygiene products for women
February 16, 2018 the actress Aislinn González Castrejón, recognized in the artistic milieu as Aislinn Derbez, initiated the complaint before the Conapred. The document alleges that on June 17, 2016, Derbez entered into a contract with L & # 39; Oreal (Frabel, SA de CV) to transfer the brand image and the provision of artistic services, in which he was required to promote the products in various media and modalities such as events, television and spectacular commercials, among others.
Even with the current contract, Derbez also signed with SCA Consumidor México, SA de CV, and Efimexa de México, SA de CV, better known under the brand name Saba, to promote its intimate hygiene products for women.
But in July 2017, L & # 39; Oreal sued Derbez by the commercial route for alleged breach of the contract, arguing that the actress had not requested permission from ### 39 "to associate one's image with intimate hygiene products" to the Saba company. in which they established their contractual obligations.
Although since October 2016 the actress has requested the permission of L'Oreal, the company rejected her claim stating that her products and those of Saba that are related to women's menstruation, are not compatible.
He argues that the company ( Saba ) "manipulates intimate hygiene products, which because of their nature, they are not compatible with those who make them manipulate, since they are dedicated to the promotion of beauty products to enhance the femininity and beauty of the woman, her hair and her face, which is not reflected pr oducts related to menstruation which implies that menstruation is something that is presumed dirty or unpleasant, although it is something natural for women, "said the legal representative of Derbez in the complaint.
the complaint was admitted by the Conapred, which analyzes whether the statements of the actress constitute or not an act of discrimination
The information was provided by the legal representative of Derbez in the complaint bearing the number CONAPRED / DGAQ / 0220 / DQ / 18 / I / CDMX / Q0220 that he presented last February before the Conapred, to argue that he suffered discrimination at work for gender reasons on the part of the company L & # 39; Oréal.
"Considers that he is the victim of discrimination by L'Oréal, by not allowing him to associate his image with intimate hygiene products, since this association 39. is not considered worthy and decent. In addition, said company, in establishing the authorizations or prohibitions in the clauses of the image transfer contract, makes an alleged act of discrimination, creating an undue stereotype, degrading and violating the rights of the petitioner ", he adds
. The actress pointed out that the company's staff offered her "treatment contrary to her dignity because of her sex, so that, if it was the case, her rights to non-discrimination, at work could be violated, as well as receive dignified and respectful treatment. "
The complaint was admitted by the Conapred, who analyzes whether the statements of the actress constitute an act of discrimination or not.
" He is eligible for treatment, qualifying the current complaint as an alleged act of discrimination. Notify the complaint and require the corresponding owner and / or legal representative of the company, "agreed Alberto Lacorte, General Manager of Conapred Complaints.
The procedure that Aislinn Derbez initiated before the Counsel is independent of the dispute by L'Oreal against him for the alleged breach of contract of the actress.
The opinion of the company L'Oréal was asked about this case and the Sources of the same have indicated that they would take a stand on the issue.
