Months later, the girl was sentenced to life imprisonment for killing her boyfriend. The court considered him "criminally responsible for the crime of homicide, because she was a person with whom she had a relationship".
Galarza confessed to the crime in January, during an interrogation that lasted several hours. At that time, all the questions were aimed at confirming his father's guilt, since he was the owner of the nine-millimeter weapon with which Pastorizzo was killed. But she broke down and dropped: "Enough, it was me, it was me, it was me, take responsibility for my father and my family". Since then, the girl has been placed in pre-trial detention after the court rejected an application for house arrest made by her defense.
Youth relations appeared to be over in December with beatings and scenes of violence between the two, according to the parents of both. However, on Sunday, December 25, Galarza and one of his friends violently attacked the young man after a dance. These facts were not recorded in any security camera, but in a WhatsApp conversation where the young man said to a friend: "He called me to the door to talk and I was like an asshole I started to put all black on my face and my cheekbone looked like a pineapple, I was swollen and my arms and my belly all beaten, so hurt ".
The attack, as the young man told his friend, was "not to want to be with her". He was confident that after this situation, the relationship would end permanently. "It was worth the shit if you stop fucking," he writes.
These events were also recorded during a conversation with a friend who allegedly hit the kid inside the club. In this conversation, Galarza told his friend that after the crossing, Pastorizzo went to his house and "broke his head".
The strategy that maintained Galarza's defense to avoid being judged as an aggravated homicide, because of the connection they maintained, was to prove that they were not boyfriends, but that they had a relationship based on going back and forth. With that, they would have managed to change the coverage of the case to a mere homicide, which would have meant that they were serving a sentence of 8 to 25 years in prison.
However, in the judgment rendered on Tuesday, the judge gave credence to the couple's relationship between the two, as well as the fact that the defendant used a lawful firearm (his father is a police officer) to "undermine" the Pastorizzo's life.
According to the judge, Galarza fired point blank at Pastorizzo while he was traveling on a motorcycle and later, when the boy was "fatally wounded", he shot him one more time. For the court the assumption of defense that the shots were accidental was destroyed.
"The two shots are by no means accidental or involuntary," says the sentence, but "intentional". Another point alleged by the defense and which has not been accredited is the fact that the girl was the victim of gender violence by her partner.
In turn, Judge Mauricio Deruddi, who was responsible for reading the sentence, explained that the basis for this decision will be announced on July 24, starting at 11 am and that the verdict was defined unanimously.
On the other hand, the court dismissed the "violence resulting from the use of a firearm" as an aggravating factor in the decision. Moreover, the judges did not understand that the crime had been committed with treason.
