The Government appeals in cassation in the Urgenda case, the last possibility to challenge a court decision. In the Urgenda case, the court and the court instructed the Cabinet to respect certain climatic objectives
. Minister Wiebes said that the state did not oppose the content of the Urgenda judgment. "We're going to run the sentence," says Wiebes. But this is a matter of principle, he says. "We want to know at the highest level if the judge can sit in the chair of politics."
Greenhouse Gas
On October 9, the Hague Tribunal upheld the previous ruling in the Urgenda case, a climate organization. The state must take steps to reduce greenhouse gas emissions in 2020 by 25 percent from 1990.
The court ruled that these climate-related measures were part of the "duty to diligence "of the government. The court also spoke of a "real threat" due to climate change. In this way, the judge made a statement about what ministers and political parties should do.
The right of cassation is applied by the Supreme Court. It does not evaluate the content of the case but checks whether the law and the rules of procedure have been applied correctly.
