New York teacher vaccination warrant: judge rejects employee offer for temporary restraining order

A New York federal judge on Tuesday rejected an offer from a group of teachers and other school employees seeking a temporary injunction against a COVID-19 vaccine warrant that went into effect in the public school system in the city earlier this week.

District Judge Mary Kay Vyskocil ruled that there was no presumption of irreparable harm in the request of the 10 educators who applied for a temporary restraining order on the basis of a religious exemption.

“The plaintiffs did not demonstrate sufficient to qualify them for a temporary restraining order,” Vyskocil said. “If I were to grant an injunction today, there could be a huge disruption to school for thousands of school children in New York City.”

The group of 10 teachers, educators and administrators were seeking to temporarily prevent the city from further enforcing the vaccination mandate, which went into effect Monday in the city’s public school system, with more than one million students.

Public school employees who fail to comply with the mandate will be placed on unpaid leave with benefits, including health care benefits. The city planned to bring in replacements where needed.

About 148,000 public school workers in the city had until 5 p.m. on Oct. 1 to receive at least their first vaccine.

Mayor Bill de Blasio said on Friday that 90% of Education Department employees had received at least one dose of the vaccine, including 93% of teachers and 98% of principals, with around 43,000 doses given since. the announcement of the mandate on 23 August. .

The country’s largest school system is one of the first in the country to require vaccines for all of its staff.

A similar mandate is expected to go into effect in Los Angeles on October 15.
