A group of New York CityPublic school teachers on Thursday asked the United States Supreme Court to block the city’s vaccination mandate for teachers.
Lawyers for Rachel Maniscalco, Evelyn Arancio, Diana Salomon and Corinne Lynch argued in a 12-page petition to Judge Sonia Sotomayor, who is the circuit justice for Circuit 2, that teachers’ due process rights and equal protection were violated by the mandate.
In attempting to tackle the COVID-19 virus, New York City, the Department of Education, and the Department of Health and Mental Hygiene have created an executive order that imposes an unconstitutional burden on school teachers public, ”the petition reads.

“Instead of giving public school employees the choice to opt out of the immunization mandate through weekly testing – an option available to other municipal employees – the decree requires unvaccinated public school employees to take time off. without pay for almost a year, ”the petition continued. “The executive decree threatens the education of thousands of children in the country’s largest public school system and violates due process guarantees and equal protective rights granted to all public school employees.
“If allowed to go into effect, the Aug. 23 decree will force thousands of unvaccinated public school employees to lose their jobs, while other municipal employees, including those with important contacts with of children, are allowed to withdraw from the vaccination mandate through weekly COVID-19 tests, ”the petition further explained.
The petition follows a federal appeals court decision to dissolve a temporary injunction against the vaccine’s mandate earlier this week. New York City public school employees have until 5 p.m. Friday to comply.

“The courts have spoken – the plaintiffs have no valid claims,” DOE spokeswoman Danielle Filson tweeted in response to news of the petition. The New York Department of Health and Mental Hygiene “has the power to implement a mandate firmly rooted in the science and expertise of public health officials across the country.”
