The baby of Nirvana’s famous “Nevermind” album cover has grown up … and now he’s suing the group for sexual exploitation of children.
A man named Spencer elden claims he’s the famous naked baby pictured in a swimming pool on the cover of Nirvana’s groundbreaking 1991 album … and he’s suing the band, its surviving members and Kurt Cobain‘s, 30 years after the album’s release.
According to a new federal lawsuit, obtained by TMZ, Elden claims he could not consent to have his image used on the album cover at the time because he was only a 4 month old baby … And says that his right the guardians did not consent to it either.
Elden takes it one step further … in his costume, he claims the image is actually child pornography. He also claims that the band promised to cover their genitals with a sticker, but this was never incorporated on the album cover.
According to the documents, Elden claims that Kurt, Dave grohl and the rest of the group failed to protect him and prevent him from being sexually exploited … and he says having his naked baby body glued to a famous album caused him damage for life.
Elden is going after the group, Kurt’s estate and others for damages… and he wants them each to pay out at least $ 150,000.
We’ve reached out to representatives for Nirvana and Kurt’s estate… so far, no word in return.
