Claims employees work for SAS without a contract

The USO union is complaining to CAE Crewing's Spanish Labor Inspection Services Trabajo recruitment agency to have SAS employees in Malaga who work without a contract.

CAE Crewing Services is an Irish company that provides cabin crew to the Irish airline Scandinavian Airlines Ireland Limited (SAS Ireland), a subsidiary of SAS. SAS Ireland is a small company with seven aircraft and completes the parent company which, in comparison, has more than 100 aircraft.

"More than half of SAS employees in Malaga, 26 out of about forty employees, work without a contract," spokesman Ernesto Iglesias said in a USO union press release.

He states that the employees decided not to sign a contract before it was adapted to Spanish labor law.

It is Dagbladet who first mentioned the case in the Norwegian media.

Similar to Ryanair

In the press release, Iglesias said that "the flagship SAS has always resorted to employment strategies similar to those of Ryanair." He also stated that the proposed contracts did not comply with the Spanish directives.

According to USO, the crew is taxed in Ireland, while he spent 183 days in Malaga. The crew will also be underpaid for the holidays and the company will have the opportunity to change their salary at any time. USO also claims that many of the contracts should be written in a language other than Spanish or one of the common languages.

SAS Knut's information officer, Morten Johansen, does not recognize USO's claims.

– This is certainly not it. Nobody flies without a contract, says Johansen to DN.

– All those traveling for SAS Ireland are employed by the CAE Training and Crew Company and formally enter into a contractual relationship encompassing all aspects of employment, such as payroll, insurance, etc. The fact that someone steals without a contract is a false statement.

Johansen indicates that SAS and London employees traveling for SAS have fixed-term contracts and collective terms of employment in line with local market standards.

– We do not recognize this complaint or compare with Ryanair. I do not know the details of the company, but the employees of SAS and London working for SAS have fixed-term contracts and collective employment conditions, in line with local market standards.

In accordance with Spanish law

– For passengers departing from Malaga, holiday pay is paid in accordance with Spanish law. Of course, agreements can not be "changed at any time" as claimed by the applicant, but there is an opportunity to increase the salary if the company so wishes. Offer it also during a contractual period. A unilateral reduction of conditions can not and should not be done outside the negotiations simply to clarify the situation.

Regarding the payment of taxes, Johansen said that CAE did not want to circumvent the rules on taxation. It now has legal assistance enabling it to guarantee its full compliance, including in relations between Spain and Ireland in the tax area.
