In an order issued Saturday night, the state Supreme Court overturned a preliminary Commonwealth Court order and dismissed the case.
“After reviewing the parties ‘filings in the Commonwealth Court, we hereby dismiss the petition for prejudicial review on the basis of the petitioners’ failure to file their facial constitutional challenge in a timely manner,” the order reads.

Following McCullough’s order, Secretary of the Commonwealth of Pennsylvania Kathy Boockvar and Wolf appealed the order to the state Supreme Court.

Originally, an emergency petition was filed in state court last weekend by the GOP ahead of Monday’s deadline to certify election results, a process that would solidify a defeat for Trump.
The plaintiffs, including Kelly, have asked the court to strike down a universal mail-in voting policy signed by Wolf and passed by a Republican legislature last year. They argued that the provisions that allowed postal voting to be expanded in the state were unconstitutional, according to the ordinance.
“As a remedy, the petitioners have sought to invalidate the ballots of the millions of Pennsylvania voters who have used the postal voting procedures established by Bill 77 and count only those ballots that the petitioners consider to be” legal votes ”, continues the ordinance.
The rejected offer is part of a multi-state effort by Republicans and Trump allies to overturn the 2020 election results in Trump’s favor. However, electoral law experts have noted that legal action taken by the Trump campaign and its allies will not achieve the desired result.
Trump has always refused to concede the election to Biden. However, the president said this week that he would leave the White House if Biden was declared the Electoral College winner.
“Definitely I will. And you know it,” Trump said when asked if he would leave the White House if the Electoral College voted for Biden.
