The four other senior judges of the Supreme Court have not yet responded to their automatic appointments
MANILA, Philippines – Acting Chief Justice Antonio Carpio has informed the Judicial and Bar Council (JBC) that he is refusing his appointment to become the next Chief Justice of the United States. Supreme Court.
"I refuse my automatic appointment for Chief Justice," Carpio told JBC in a letter.
Carpio has already said that he did not want to take advantage of the reversal of the quo warranto of former Chief Justice Maria Lourdes Sereno, which he had objected to.
In the current state of affairs, the other 4 most senior judges are appointed for the position: Associate Judges Presbitero Velasco Jr, Leonardo Teresita de Castro, Diosdado Peralta and Lucas Bersamin. They all still have to answer their nominations.
Velasco retires August 8, De Castro in October, and Bersamin in October 2019. Peralta will serve until March 2022.
The deadline for applications for chief justice is on July 26.
Justice Secretary Menardo Guevarra stated that the JBC accepted that senior judges, who were automatically appointed, must accept nominations in order to be considered a candidate.
"The same rule will continue to be applied, even the oldest candidate must agree to be appointed," Guevarra said.
Traditionally, the bench will vote to recommend to the JBC. Court insiders have said that anyone who is recommended will guarantee a vote by Carpio, who is the JBC chair in his capacity as acting chief justice.
The candidates will be the subject of public interviews, then a list will be sent to President Rodrigo Duterte
