Chapter I
INITIAL PROVISIONS

§ 1
Service Provider

1. The service provider is INFOR Biznes sp.O.o. with headquarters in Warsaw, ul. § 2
Service

3. The services offered on the Site include:

§ 3
Application

1. This Regulation (hereinafter 'the Regulation') constitutes the regulation on the supply of electronic services within the meaning of the Law of 18 July 2002 on the supply of electronic services and defines the rules for the provision of services via website.
2. The recipient of the service is required to comply with the provisions of the regulation from the moment he begins to use the website.
3. In the field not regulated by the regulations, also apply:
(a) the regulations for promotional campaigns referred to in § 9;
b) regulations governing the distribution of access to the website by entities other than the service provider, if access is granted by these entities (for example, the regulations of the online store www. sklep.infor.pl);
c) Payment by SMS referring to the payment execution service provided to the customer by eCard S.A. with its head office in Gdańsk (see § 8 section 2).

§ 4
Technical requirements

1. To use the website, it is necessary: ​​
a) a device having Internet access with a current version of the correctly configured web browser,
b) e-mail account active (email).
2. In the case of SMS payment, it is also necessary to have access to a device for sending, receiving and reading SMS.

§ 5
Access

1. Access to certain services or parts of the Site's services may be subject to:
a) Office Order (paid or unpaid),
b) express the consents referred to in § 15 or use the promotional code referred to in § 9;
c) connection.
2. The service is ordered via the order form or by telemarketing in accordance with the Regulations. In the case of the service ordered by the online store referred to in Article 3 para. 3, the order of the rules of this store applies to the order.
3. The time of access to the service requiring a connection is counted from the sending of the login and password by Customer Service to the recipient's e-mail address. service, and in the case of SMS payment – the sending of the recipient of the access code.
4. The service provider has the right to refuse to start the service if the data sent by the customer is incorrect or incomplete.

Chapter II
ORDER

§ 6
Purchase Order

1. The placing of an order for a service on the Site is done by entering into the ICT system of the service provider, on the order form, the data necessary to individualise the recipient, in particular by providing the recipient's e-mail address. , which is his identifier.
2. Placing an order is possible after submitting a statement on the acceptance of the settlement.
3. In promotional activities, the customer has the possibility, before placing an order, to enter a promotion code or a discount code (see § 9)
4. When ordering access to the service, the buyer of the service may request that the service be started before the end of the period of exercise of the right of withdrawal (see § 11). Further access to purchased content is possible after entering the access code into the service provider's computer system, while attempting to activate that content to which access has already been purchased .
9. The user of the service is required to secure the username, password, promotion code, discount code and access code against unauthorized access.
10. The recipient of the service is obliged to inform the service provider immediately of the modification of his e-mail address. If the service provider is not informed of the change of e-mail address, it is assumed that all statements and information sent by the service provider to the customer to the e-mail address provided by the service provider to the e-mail address provided by the service provider. § 7
Telesales

In both cases, the customer will be notified by e-mail.

§ 8
Payment

1. Subject to the provisions of 2, the recipient of the service should pay for the paid service within 14 days of the conclusion of the contract. The payment is made on the basis of an invoice issued by the service provider, by transfer to a bank account 97 1140 1010 0000 5239 4300 1012.
2. However, if the service provider buys access to individual articles published on the website or at the e-publishing numbers of Dziennik Gazeta Prawna, the payment is made as indicated in the payment by SMS. § 9
Promotions

1. The service provider may organize promotional campaigns.
2. In particular, the service provider may offer free access to the full version of the website under the conditions specified each time in the promotional offer, after completing the purchase order. The User of the Service who uses such promotion by ordering the Site, enters the Promotion Code received on the form, in a designated place.
3. The service provider may offer a discount for paid services. The recipient, who uses such a promotion, enters the discount code received on the form, in a designated place.
4. The service provider may offer goods or services (or rebates on them) free of charge to purchasers of services who have a paid service contract. The withdrawal of the contract by the customer will result in the obligation to return such a good or service.
5. The promotion may be limited in time or in the number of access granted. In the case of a limit as to the quantity, priority is given to the order.
6. Before the end of the free access period, the service provider may offer the customer a paid subscription to use the site's resources.
7. The service provider may also offer other forms of access to the paid resources of the website.

Chapter III
SOLUTION, TERMINATION, WITHDRAWAL,
WARRANTY AND GUARANTEE

§ 10
Termination and Termination

1. The termination of the contract for a paid service may be made by agreement between the parties.
2. A recipient of the service who has placed an order for a free service may terminate the contract for its provision at any time without giving reasons. To do this, you must send an e-mail asking not to be registered to the e-mail address: [email protected].
3. At the express request of the recipient, the service provider may deactivate their unique password, but this does not mean the termination of the contract.

§ 11
Withdrawal of the contract

1. The provisions of this paragraph apply only to contracts in which the beneficiary is a natural person who enters into a contract which is not directly related to his professional activity or professional activity ( consumer).
2. The customer can withdraw from the contract within 14 days without giving any reason.
3. The period of withdrawal from the contract begins on the date of conclusion of the contract.
4. The consumer may withdraw from the contract by sending a clear statement of withdrawal of the contract to the service provider. He may use the model declaration set out in Annex 1 to this Regulation. The declaration must be sent to the e-mail address: [email protected]. 7. When ordering access to the service, the recipient of the service has requested the start of its execution before the date of exercise of the right of withdrawal, after the withdrawal of the contract, it is obliged to pay for the completed benefit until that moment. The amount of the payment is calculated in proportion to the extent of the service provided, taking into account the price or remuneration agreed in the contract. However, if the service provider has fully provided the service, the right of withdrawal is not payable.
8. The service provider shall reimburse the payment using the same method of payment as that used by the customer, unless the customer has clearly indicated another method of return with a declaration of termination of the contract.

§ 12
Claims

1. The service provider is liable to the buyer if the item sold has a physical or legal defect (warranty). The rules of this responsibility, including: the type of claims acquired from the buyer (elimination of defects, exchange of items, price reduction, withdrawal from the contract) and the time they occur are the result of the law applicable, see in particular the art. 556-576 of the law of 23 April 1964 – Civil Code (consolidated text, Journal of Laws 2014, point 121, as amended).
2. In order to file a complaint, the buyer must send a traditional declaration or an e-mail address to the Customer Service containing the type of request and the data allowing the Service Provider to contact the Service Recipient (at least name and address PO). In order to speed up the claim procedure, we recommend that you include a proof of purchase (eg a VAT invoice) or a copy of the product with the advertised product.
3. The Service Provider may ask the Customer to complete any missing claim. The service provider is required to respond to the complaint request within 14 days of notification.
4. The provisions of this paragraph apply accordingly to all the comments of the recipients of services concerning the functioning of the website.

§ 13
Warranty

1. Due to its nature, the site is not covered in principle by the guarantee. However, if a warranty has been granted in connection with the provision of the service, the obligations of the guarantor and the warranty rights of the buyer are specified in a separate guarantee document delivered to the consignee.
2. The recipient of the service may, at his option, comply with the guarantee procedure described in the guarantee document or comply with the complaints procedure described in Article 12 of the Regulation.

Chapter IV.
PRIVACY POLICY

§ 14
Personal data

1. By providing the purchase order, the Service Provider defines the recipient's personal data whose application is necessary to conclude a service contract. Providing personal data is voluntary. Refusal to provide personal data may prevent the service provider from providing the services.
2. The service provider may process, inter alia, the following personal data:
(a) surname and first name of the addressee,
(b) PIN number,
c) address of residence or stay,
(d) address for correspondence, if different from the address of residence or stay,
e) e-mail address,
f) telephone number,
g) date of birth.
3. The administrator of personal data within the meaning of the law of 29 August 1997 on the protection of personal data (consolidated text, Journal of Laws 2015, item 2123) is INFOR BIZNES sp. and INFOR PL SA. The registered office of the companies is ul. Okopowa 58/72, 01-042 Warsaw.
4. The personal data of the recipients of the service will be processed by the service provider and the companies of the INFOR PL group for the purpose of executing the contract, providing services, archiving, selling products and services offered by companies and for marketing purposes. In particular, the provider is entitled to process the personal data of the recipient necessary to establish, shape the content, modify or terminate the contract for the provision of services by the provider and provide services in accordance with the Regulation and the law of 18 July 2002 on electronic services (consolidated text of 2013, item 1422 as amended), and in the case of express consent of the recipient, also for the sending of commercial information electronically or for the The use of telecommunications terminal equipment and automatic call systems for direct marketing (see § 15).
5. The recipient of the service has the right to inspect his personal data, modify and delete it after contacting customer service.

§ 15
Consent

1. Notwithstanding the provisions of the preceding paragraph, when ordering, the Customer may submit the following declarations:
a) "I agree to receive commercial information through electronic communications of INFOR PL Group companies and cooperating entities."
b) "I accept the use of telecommunications terminal equipment and automated call systems for direct marketing purposes by INFOR PL group companies."
c) "I accept the use of telecommunication terminal equipment (eg telephone) and automated call systems for direct marketing purposes for entrepreneurs of INFOR group companies PL. "
The statements above are independent of the time of use of the services provided by the INFOR PL group companies.
2. Consent is voluntary. However, this may be a condition for the provision of a free service.

§ 20
Amendments to the regulations

1. The Client is bound by this version of the Regulation, which he accepted at the conclusion of the contract.

b) Usługa – usługa realizacji płatności za dostęp do Treści zamieszczonych w Serwisie, realizowana przez Operatora za pomocą kanałów multimedialnych Operatorów GSM, w formie bezpiecznej wymiany kodów, oferowana Użytkownikom, będących jednocześnie użytkownikami telefonii komórkowej;
c) Operator – eCard S.A. z siedzibą w Gdańsku, przy ul. Arkońskiej 11, zarejestrowana w Sądzie Rejonowym Gdańsk- Północ w Gdańsku VII Wydział Gospodarczy Krajowego Rejestru Sądowego, pod numerem KRS 0000042304, NIP 521-31-03-040, REGON 016341786, kapitał zakładowy 16 840 000,00 zł (w całości opłacony). e) Użytkownicy – osoby korzystające z dostępu do Treści, realizujące płatność poprzez skorzystanie z Usługi;
f) Treść – treści cyfrowe dostępne dla Użytkowników po zalogowaniu do Serwisu i dokonaniu
płatności poprzez skorzystanie z Usługi, w zakresie i na warunkach aktualnej oferty handlowej
Infor. Treść może objąć m.in. pełną wersję artykułów, dokumentów, gazet i czasopism
elektronicznych, e-booków, plików multimedialnych, raportów, baz danych, archiwów,
infoserwisów, serwisów typu chat, forum, dział porad lub usług hostingowych;
g) Operator GSM – osoba prawna świadcząca usługi bezprzewodowej telefonii komórkowej
telekomunikacyjnej, w szczególności takie podmioty jak: Polska Telefonia Cyfrowa sp. z o.o.,
Polkomtel S.A., PTK Centertel sp. z o.o.;
h) Numer Dostępowy – numer SMS Premium podany w Serwisie zawierającym Treść;
i) Kod Identyfikujący – znaki alfanumeryczne identyfikujące Treść;
j) Kod Dostępu – unikalny kod kontroli dostępu oparty o znaki alfanumeryczne, umożliwiający
korzystanie z Treści uprawnionym Użytkownikom;
k) Wiadomość SMS – odpowiednio sformatowana wiadomość tekstowa zawierająca Kod
Identyfikujący, wysyłana przez Użytkownika na Numer Dostępowy w celu uzyskania Kodu
Dostępu;
l) Wiadomość Zwrotna – odpowiednio sformatowana wiadomość tekstowa w ramach realizacji
Usługi kontroli dostępu, odsyłana przez Operatora w odpowiedzi na Wiadomość SMS pod
numer telefonu, z którego wysłana została Wiadomość SMS, zawierająca Kod Dostępu albo
informację, że wiadomość nie została poprawnie rozpoznana.

§2
ZASADY DZIAŁANIA USŁUGI

1. W ramach Usługi, Użytkownicy wysyłający Kod Identyfikujący w Wiadomości SMS na Numer
Dostępowy uruchamiają procedurę uwierzytelnienia dostępu do Treści, realizowaną poprzez
przesłanie Kodu Dostępu na numer telefonu komórkowego, z którego wysłana została
Wiadomość SMS.
2. Wiadomość SMS musi zawierać Kod Identyfikujący.
3. Po otrzymaniu przez Operatora poprawnej Wiadomości SMS z Kodem Identyfikującym,
Użytkownikowi zostanie przydzielony Kod Dostępu, który zostanie następnie przesłany
Użytkownikowi w treści Wiadomości Zwrotnej.
4. Koszt wysłania Wiadomości SMS jest zgodny z aktualnymi cennikami Operatorów GSM dla
wiadomości typu SMS Premium.
5. Opłaty za wysłanie Wiadomości SMS pod Numer Dostępowy nie podlegają zwrotowi w
żadnym wypadku.
6. Uzyskanie dostępu do Treści nie oznacza nabycia do nich przez Użytkownika praw
autorskich. Użytkownik ma prawo wykorzystywać wspomniane Treści w sposób zgodny z
ustawą z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych.
7. Zasady korzystania z dostępu do Treści, czas dostępu do Treści i czas ważności otrzymanego
Kodu Dostępu, informacje o ważności Kodów Dostępu oraz ich funkcjonalności regulują
właściwe regulaminy Infor.
8. Numery telefonów, z których wysłano Wiadomość SMS będą przechowywane w systemie
Operatora w celu identyfikacji Użytkownika i nie będą wykorzystywane do innych celów, chyba
że Użytkownik na podstawie odrębnej umowy z Operatorem wyraził zgodę na przetwarzanie
danych dla innych celów.

§3
DOSTĘPNOŚĆ USŁUG I REKLAMACJE

1. W przypadku wysłania na Numer Dostępowy Wiadomości SMS o treści innej, niż Kod
Identyfikujący, na telefon komórkowy Użytkownika, z którego wysłana została Wiadomość
SMS, zostanie odesłana Wiadomość Zwrotna z informacją, że Wiadomość SMS nie została
poprawnie rozpoznana.
2. Operator nie ponosi odpowiedzialności wobec Użytkowników za niewykonanie lub nienależyte
wykonanie Usługi z przyczyn leżących po stronie Operatora GSM, dostawców usług
internetowych, z powodu błędu Użytkownika (w tym spowodowanymi błędami w informacjach i
Regulaminach Infor) oraz osób trzecich, ani spowodowanych działaniami siły wyższej, w
szczególności za reklamacje związane z niedostarczeniem, opóźnieniem dostarczenia lub
nieregularnym dostarczaniem zamówionych Kodów Dostępu.
3. Operator nie ponosi odpowiedzialności za skutki wysłania Wiadomości SMS z telefonu
Użytkownika przez osoby nieuprawnione.
4. Operator jest uprawniony do czasowej przerwy w świadczeniu Usług z przyczyn technicznych.
Operator dołoży najwyższej staranności, aby wskazane wyżej przerwy miały miejsce w
godzinach nocnych i trwały możliwie najkrócej. Przerwy w świadczeniu Usług z przyczyn
technicznych nie mają wpływu na ocenę wykonania przez Operatora zobowiązań z tytułu
umożliwienia Użytkownikom korzystania z Serwisu.
5. Przedmiotem reklamacji jest wykonanie przez Operatora Usługi niezgodnie z warunkami i
zasadami określonymi w niniejszym regulaminie.
6. Składanie reklamacji odbywa się tylko i wyłącznie za pomocą poczty elektronicznej pod
adresem [email protected].
7. Reklamacja powinna zawierać imię i nazwisko osoby dokonującej reklamacji, numer telefonu
komórkowego, z którego wysłano Wiadomość SMS, treść wiadomości, przybliżoną datę i czas
wysłania wiadomości oraz zwięzły opis zastrzeżeń.
8. Reklamację należy zgłaszać w terminie 7 dni od daty wysłania Wiadomości SMS.
9. Jeżeli reklamacja wymaga uzupełnienia, Operator zastrzega sobie prawo do zwrócenia się do
Użytkownika z prośbą o uzupełnienie przekazanych informacji.
10. Reklamacje będą rozpatrywane w terminie do 7 dni roboczych od daty otrzymania przez
Operatora. W przypadku braku możliwości rozpatrzenia reklamacji w tym terminie Operator
zobowiązuje się do poinformowania Użytkownika o tym fakcie.
11. Operatorzy GSM odpowiadają jedynie za usługi telekomunikacyjne umożliwiające realizację
Usługi.
12. Upusty cenowe dla grup abonentów na opłaty abonamentowe oraz usługi dodatkowe nie mają
zastosowania do Numeru Dostępowego.
13. Operator zastrzega, iż Wiadomości SMS wysłane przez: pracowników, zleceniobiorców,
współpracowników oraz z kart testowych Operatorów GSM mogą nie być uwzględniane w
ramach Usługi.

§4
POSTANOWIENIA KOŃCOWE

1. Regulamin dostępny jest w siedzibie Operatora oraz na właściwych stronach internetowych
Infor. Regulamin może być zmieniony przez Operatora w dowolnym czasie poprzez
zamieszczenie zmian na ww. stronach internetowych. Wszelkie zmiany do regulaminu stają
się skuteczne od chwili ich publikacji, o ile nie zastrzeżono inaczej. Zmiany nie znajdują
zastosowania do Usług, które zostały zamówione przez Użytkownika poprzez Wiadomość
SMS wysłaną przed zmianą regulaminu.
2. Prawem właściwym dla wszystkich stosunków prawnych wynikających z niniejszego
regulaminu jest prawo polskie. Wszelkie spory będą rozstrzygane przez właściwe polskie sądy
powszechne.
3. W sprawach nie uregulowanych niniejszym regulaminem zastosowanie mają odpowiednie
przepisy prawa.
